Gov. Wolf’s School Mask Mandate Rejected In Pennsylvania Court

Judges said that Gov. Wolf’s administration did not have the authority to issue the order.

“PENNSYLVANIA — The school mask mandate in Pennsylvania was ruled illegal by the Commonwealth Court on Wednesday, with judges arguing that Gov. Tom Wolf’s administration did not have the power to unilaterally issue that order in the absence of a public health emergency.

The decision comes just says after Gov. Wolf said the mandate would be lifted and control over that decision would be returned to local school districts come Jan. 17, 2022.

“The law is clear in this case,” Senate President Pro Tempore Jake Corman (R-Bellefonte), who filed the suit with other petitioners, said in a statement. “The Acting Secretary of Health does not have the authority to create new rules and regulations out of thin air. Today’s ruling validates what we have said all along – mask decisions should be made by parents and school boards, NOT unelected bureaucrats.”

Important facts to consider from an informed PA Parent: 

This is a win.  But while parents are celebrating, children are still in grave danger at school.  They are still contact tracing, quarantining, pcr testing, and injecting children at school.  And parental consent?  A document on the WHO website states that just sending your child to school is implied consent.

“3. An implied consent process by which parents are informed of imminent vaccination through social mobilization and communication, sometimes including letters directly addressed to the parents. Subsequently, the physical presence of the child or adolescent, with or without an accompanying parent at the vaccination session, is considered to imply consent. This practice is based on the opt-out principle and parents who do not consent to vaccination are expected implicitly to take steps to ensure that their child or adolescent does not participate in the vaccination session. This may include not letting the child or adolescent attend school on a vaccination day, if vaccine delivery occurs through schools.”

 

There is also a mature minors doctrine in some states, including PA, which allows for children ages 14-17 receive medical treatment without their parents knowledge or consent. It’s possible that schools are going to try to separate children at school from their parents until they are either tested or jabbed.   There was a school in Ohio that had an emergency evacuation drill, and bussed all students to a undisclosed location for the entire school day and parents did not know where they were. (flyer attached)  The school district also posted it on their fb page.  Pam Popper confirmed that this did take place.

 

The “Shielding Approach”  on the CDC website suggests separating “the high risk population” from the rest of the population to prevent the spread of COVID 19.

Here the CDC recommends parents to send their children to school with and emergency overnight bag in case they are separated from their parents overnight during an emergency.

Also see letters from the PA dept of Health, threatening children that they will separate them from their parents if they do not cooperate with quarantining.  (attached)

I keep sharing this information with as many parents and groups as I can, but only a few parents pulled their children from school because of the information I shared.
